If you visit or shop at Mad Dog or maddog.com, you accept these terms and conditions. If you make a purchase, use any current/future service, or visit Mad Dog or maddog.com, you also will be subject to the policies and terms of purchase applicable to such service or sale.

SITE POLICIES, MODIFICATION, AND SERVICEABILITY
Please review all policies posted on this site. These policies also govern your visit to maddog.com. We reserve the right to make changes to our site, policies, and any conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
CUSTOMER RESPONSIBILITY
Customers must be at least 18 years of age to purchase any item from Mad Dog. Customers must be of legal age to own any items ordered. Customers must be at least 21 years of age if purchasing a hand gun or ATF-defined “OTHER” firearm (including, but not limited to, frames, pistol-grip shotguns, and stripped receivers) OR ammunition or ammunition components for use in handguns. Mad Dog may request a copy of your state identification before shipping your order. Customers are responsible for checking all local laws before ordering or using any item from Mad Dog. Customers are responsible for complying with all firearms laws in their area. Customers are to notify us immediately should you have any concerns about the legality of any product you have ordered. Any customer making a purchase through us agrees to follow all manufacture safety instructions and to only use the product(s) in a safe manner in an approved area for a legal purpose. Customers assume all responsibility for the legality of a specific item when you purchase it. Customers must provide a valid contact phone number with any order placed. Mad Dog may contact you at the provided phone number before processing any order. Customers are responsible for payment for all orders placed through this online system. If you are not sure if you want something please do not order it. When making a purchase from Mad Dog, customers agree they are not prohibited by Federal or State law, or local ordinance, from receiving firearms or ammunition, or ammunition components, of any kind. Customers agree they are the actual transferee/buyer of the firearm(s) being purchased. Customers agree they are not a fugitive from justice. Customers agree they are not an alien illegally in the United States. Customers agree they have never renounced United States citizenship. Customers agree they are not currently on Federal NICS or State agency DELAY/DENIED status regarding your most recent attempt to purchase a firearm. Customers agree they have not been convicted in any court of a felony, or any other crime, for which the judge could have imprisoned you for more than one year. Customers agree they are not under indictment for a felony, or any other crime that a judge could imprison them for. Customers agree they have not been convicted in any court of a misdemeanor crime of domestic violence. Customers agree they are not subject to a court order restraining you from stalking, harassing, or threatening anyone. Customers agree they have not been discharged from the Armed Forces under dishonorable conditions. Customers agree they have never been adjudicated mentally defective or have not been committed to a mental institution. Customers agree they are not an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance. Customers understand that cleaning, handling, or discharging firearms, ammunition or ammunition components may cause exposure to lead and they hold Mad Dog harmless and assume all responsibility for any lead exposure.
RETURNS
Firearm Returns – Once a new firearm is transferred to you it is considered used, even if it is unfired. TRANSFERRED FIREARMS CANNOT BE RETURNED. Mad Dog cannot provide a full refund for new firearms once they have been transferred into your possession. Also, we do not reimburse FFL transfer fees on returned items. We do understand that some manufacturer defects may not be identifiable upon initial inspection. However, upon discovering a defect after the transfer, it is best to return the firearm directly to the manufacturer for replacement or repair (in accordance with manufacturer’s warranty policy). By sending a defective firearm directly to the manufacturer, you can avoid the unnecessary transfer fees of returning the firearm to us through your local FFL dealer. We are more than happy to assist you through this process. Mad Dog will accept returns on firearms that have not been transferred, but a 25% restocking fee plus return shipping will apply. In some cases a gift card/store credit will be issued for the refund. Refunds or store credits are not issued on item(s) until they are returned and inspected.
Please note that Mad Dog will not permit the return of the following products:
1. Special orders and products that are custom configured to your specifications.
2. Products sold "as is" or "used" or that have been installed or used after receipt.
3. NFA items that require ATF Transfer after the start of paperwork.
4. Ammunition, Illumination devices, electronic sights, optics and night vision equipment.
ACCESSORY RETURNS
Returns are only accepted for merchandise found defective immediately upon receipt and returned within ten calendar days of receipt. Accessory items that have been opened from the manufacturer packaging cannot be returned. Mad Dog will not accept returns on items that have been installed or mounted. Most accessory items have a manufacturer warranty. Please contact the manufacturer if there are any issues after installation. Original shipping charges are NOT refunded if the item is NOT found to be defective. Customers are responsible for return shipping. Returned orders may also be subject to a 10% restocking fee if unopened and 25% restocking fee if opened. In some cases a gift card/store credit will be issued for refund. Refunds or store credits are not issued on item(s) until they are returned and inspected.
AMMUNITION RETURNS
All Ammunition Sales / Ammo Components are Final and Non-Returnable. Returns cannot be accepted.
PLEASE DO NOT ATTEMPT TO RETURN PACKAGES TO THE ADDRESS ON THE BOX. WITHOUT A Return Mailing Address WE WILL BE UNABLE TO VERIFY YOUR RETURN AND ISSUE A REPLACEMENT OR REFUND.
NOTE: We recommend that you use a carrier that offers shipment tracking for all returns, and either insure your package for safe return or declare the full value of the shipment so that you are protected if the shipment is lost or damaged in transit. If you choose not to use a carrier that offers tracking and insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping. The customer is responsible for shipping charges both ways on returns, as well as for shipping charges on shipments that are refused.
CANCELLATION OF ORDERS
We invest money and time to prepare every order that is placed on our website, even before the order ships. After you have placed your order online or over the phone, you will be charged a 10% Cancellation fee on the order total if you decide to cancel it. If an order has already been packaged and prepared for shipment or has shipped then you will be charged a 25% Cancellation fee on the order total if you decide to cancel it. By placing an order online or over the phone, you agree to pay this 10% or 25% cancellation fee plus forfeit any shipping and handling charges if you choose to cancel your existing processed order. If you choose to cancel an item or order that includes a product that you backordered you also agree to pay the 10% or 25% cancellation fee. We apologize for these cancellation terms, but the firearms industry works differently than general merchandise.
ONLINE PRICE / DESCRIPTION ERRORS / AVAILABILITY
Occasionally we have only one item in stock and more than one person orders it. When this happens we honor the first funded order. If we run out of stock we will cancel your order and fully refund your money with no fees to you. If an order contains more than one item and an item is out of stock, Mad Dog will still fill the order and issue a refund for any of the items that are out of stock. Our online inventory changes every day. Occasionally an item may appear on the site by mistake or the item's description may contain a typographical error. We do not guarantee that titles, descriptions, pictures or prices on our site are complete, error-free, reliable, or current. Mad Dog streams live prices from several different distributors. Due to availably and price changes between these different distributors all sale prices are final. Price adjustments are not eligible on any order that has been placed and we cannot issue a raincheck for sale priced items. We reserve the right to refuse any order including but not limited to orders for items with errors in the description or price. We also reserve the right to refuse any order where a nonvalid coupon code is used. In the event that we cancel an order we will refund your money or issue a gift card. If the order is mistakenly shipped, we may advise the customer to return the item in an unopened condition and we will refund the customer. By placing an order, the customer agrees that the seller will be the final arbiter of any discrepancies.
USED FIREARMS
The seller provides all descriptions for used items. All descriptions for used items are honest and based on actual items being offered for sale. Items being sold in this manner will be marked as such. All sales on used items are final. Photos will be provided when available.
SHIPPING
Most individual firearms and accessories ship for $9.99 to $29.99. This excludes firearms shipping to Alaska and Hawaii. Whenever possible, Mad Dog will combine shipping. Certain firearms and accessories can be drop shipped from various warehouses, causing the shipping rates to increase or vary. Any firearm or accessory shipped from another warehouse can incur additional shipping cost. Shipping insurance can be offered and is optional upon request. Mad Dog is not responsible for uninsured items lost or damaged in transit. If you would like to review the total shipping charges for your order this can be viewed in in the cart prior to checkout. All shipping and handling charges cover the cost of standard shipping. Expedited shipping can be requested but shipping fees will be greater. You must contact us at sales@maddog.com for a quote. All orders process and ship within 3-10 business days upon receipt of full payment and a valid FFL unless otherwise noted somewhere else on maddog.com. Mad Dog offers shipping to addresses within the United States only. The cost to ship to Alaska and Hawaii varies by item, shipment, and shipping option. Shipping method and rates to Alaska and Hawaii will vary. Mad Dog will not ship to any international destinations including Puerto Rico. For all non FFL items ordered, the billing address must match the shipping address. Non FFL items ordered will ship to the billing address. Mad Dog will not ship to P.O. Boxes.
RISK OF LOSS
All items purchased from Mad Dog are made pursuant to a shipment contract. The risk of loss and title for such items pass to the customer upon our delivery to the carrier.
FIREARM SHIPPING – FFL TRANSFERS
Mad Dog will only ship firearms to individuals or agencies with a valid FFL (Federal Firearms License). In some cases Mad Dog may choose not to ship firearms to certain dealers. Though these dealers may appear on a list these dealers could be flagged and may not be used for transfers. The list on maddog.com is there to provide you with a convenient way to see what local FFL dealers are in your area. Customers may use local dealers that are not on the list by contacting us through the Help Desk or emailing us at sales@maddog.com. Mad Dog has no affiliation with any FFL’s on the list. Be aware that it is customary for your local dealer to charge a transfer fee at the time you pick up your purchase. These transfer fees can vary by region and dealer. Transfer fees are strictly between you and your local dealer. Certain dealers also apply sales tax. Please check with your local dealer concerning their policies. The actual transfer of the firearm, transfer fees and sale tax will be between you and your FFL dealer. Mad Dog does not guarantee information provided by any other FFL dealers or their websites. Mad Dog only collects sales tax if you reside in the state of Florida. Customers are responsible for contacting the transferring FFL to get approval for the transfer prior to placing an order with Mad Dog. It is also the customers responsibility to contact the FFL and have them send a copy of their FFL to us via email at sales@maddog.com. It is the customers responsibility to ensure that a firearm you are transferring is legal to own in your state. Additional shipping cost can apply to orders that experience shipping issues with the FFL Dealer you choose.
GENERAL FIREARM SALES
All firearms, magazines, receivers and restricted law enforcement items are sold and shipped in accordance with all existing federal, state and local laws and regulations. Many of the firearms, magazines and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering. It is your responsibility to ensure that a firearm is legal to own in your state. All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories and applicable warranty. Firearms requiring warranty work must be returned to the factory within 1 year of purchase for repair. Accessories and special order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special order items.

CONSUMER DATA PRIVACY
We respect your privacy and are committed to protecting it. The Credit Card Billing Information, Shipping Information, and Contact Information in our checkout process are required in order to process your order and deliver the product to you. We store some information for accounting reasons. Your information will not be shown to third parties not involved in the transaction, nor used to send you any unrequested information. The entire Checkout process is handled through a secure SSL-encrypted connection. The Credit Card Billing Information is sent directly to our payment provider who processes your credit card transaction. The credit card information is neither recorded nor stored by us, and it can only be accessed by our payment provider. Each transaction has a very high level of security. Your credit card details are sent directly to the payment provider over a secure SSL-encrypted connection. They are not processed on our servers at any stage of the transaction, nor are they stored on our server.
YOUR ACCOUNT
You must be at least 18 years of age to create an account on maddog.com. You agree that it is your responsibility to maintain the confidentiality of your account. You agree to accept responsibility for all of the activities that occur under your account and password. Mad Dog reserves the right to suspend accounts, terminate accounts, cancel orders, refuse service, and remove or edit account information.
REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT
Mad Dog encourages feedback, suggested ideas, and reviews as long as the content is not untruthful, defamatory, illegal, threatening, obscene, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain political campaigning, commercial solicitation software viruses, chain letters, mass mailings, or spam. You agree to not impersonate any person or entity or use false email addresses.
If you do post content or submit material, and unless we indicate otherwise, you grant Mad Dog and its affiliates a nonexclusive, perpetual, irrevocable, royalty-free, and fully sub licensable right to use, publish, replicate, modify, adapt, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Mad Dog and its affiliates the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post and that the content is accurate. You also acknowledge that use of the content you supply does not violate this policy and will not cause injury to any person or entity. You agree to indemnify Mad Dog or its affiliates for all claims resulting from content you supply. Mad Dog does not regularly review posted content but does reserve the right to remove or edit such content. Mad Dog has the right but not the obligation to monitor, edit or remove any activity and content. Mad Dog takes no responsibility and assumes no liability for any content posted by you or any third party.

Any unauthorized use terminates the permission or license granted by Mad Dog. You are granted only limited and nonexclusive rights to create hyperlinks to the home page of maddog.com so long as the link does not portray maddog.com and its affiliates, or their products or services in a counterfeit, deceptive, disparaging, or otherwise distasteful matter. This limited grant is revocable. You may not use Mad Dog logo or other proprietary graphics or trademarks as part of the link without written permission.

To the full extent permitted by law, maddog.com disclaims all implied warranties, including and not limited to implied warranties of merchantability and fitness for a particular reason. Mad Dog does not warrant that the website, emails sent, or servers are free of viruses or damaging components. Mad Dog is not responsible for any damages that could arise from the use of the website. These damages also include but are not limited to anything indirect, direct, incidental, punitive, and consequential. Some State laws exclude limitations, implied warranties, or limitations of certain damages. APPLICABLE LAW
By visiting Mad Dog, you agree that the laws of the state of Florida, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Mad Dog.
CHANGES IN POLICY
Mad Dog reserves the right to modify, alter, delete and update these policies at any time we see fit. Such alterations do not nullify our rights if infringements or breaches occurred under a previous version of these conditions.
